Social Media Marketing Privacy & Policy

Mueble Solutions (003155304-P) (“we,” “us,” or “our”) is committed to protecting and respecting your privacy. This policy outlines how we handle your data, communication practices, and terms that govern our services. By using our services or website, you agree to the following terms:

1. Scope of Services

We provide social media marketing and related services, which may include content creation, custom graphics, analytics, and advertising campaign management. All work is completed under specific terms, with details outlined in client agreements.

2. Data Collection and Handling

  • Types of Data Collected: We may collect personal data such as names, contact information, and any assets (e.g., images, logos) provided by the client for project purposes.
  • Purpose of Data Collection: To perform and deliver the agreed-upon services effectively.
  • Data Security: All collected data is handled in accordance with the Malaysian Personal Data Protection Act 2010 (PDPA) and relevant laws. Client data is stored securely and protected from unauthorized access.

3. Consent for Documentation

Clients consent to the recording and documentation of all communications, including:

  • Phone calls
  • Virtual meetings
  • Emails and text messages

This ensures transparency and protects both parties.

4. Technical Support and Service Boundaries

  • Our support is limited to services outlined in our agreements. We do not offer assistance with third-party integrations or tools outside our control.
  • We provide 2D and mild 3D content. Full 3D model development or higher-dimension content will incur additional charges.

5. Client Cooperation and Communication

  • Single Representative Communication: We communicate only with the designated representative from the client’s company. Any other interference will not be entertained.
  • Timely Feedback: Delays in feedback or required approvals from the client may affect project timelines. Mueble Solutions is not responsible for such delays.
  • Content Provision: Clients must provide necessary information, assets, or access in a timely manner to avoid project delays.

6. Working Hours and Availability

  • Business Hours: Monday to Friday, 9:00 AM to 6:00 PM (Malaysian Time). We are closed on Malaysian public holidays and company-sanctioned event/festival days.
  • After-Hours Policy: Messages, emails, or calls outside of business hours, including holidays, will not be entertained. Monitoring of posts or campaigns scheduled outside these hours will occur on the next working day.

7. Revisions and Edits Policy

  • We allow up to three revisions per draft. Additional revisions will be charged at RM20 per revision.

8. Confidentiality and Non-Disclosure

All parties must adhere to confidentiality terms and ensure data privacy. Any breach of these terms may result in termination of service and potential legal action in accordance with Malaysian law.

9. Ownership and Usage Rights

  • Content Ownership: We retain ownership of all created content until full payment is made. Ownership is transferred to the client upon receipt of payment.
  • Portfolio Use: We may use completed work for our portfolio and company profile unless otherwise restricted by the client in writing.

10. Platform Compliance

We are not responsible for content removed or restricted by platforms or for account bans. Clients must comply with platform policies and ensure all licenses are in place.

11. Indemnification

Clients agree to indemnify and hold us harmless from any claims, liabilities, or damages arising from the use of content or advertising, especially if client-provided assets violate third-party rights.

12. Non-Solicitation

Clients agree not to solicit or hire Mueble Solutions’ employees or contractors for one year post-agreement.

13. Client Conduct

Inappropriate behavior, abuse, or hostility directed at our team members will result in service termination and action as per the Employment Act 1955.

14. Force Majeure

We are not liable for any service failure due to circumstances beyond our control, such as natural disasters, pandemics, or government-imposed restrictions.

15. Early Termination and Refund Policy

  • Service Suspension: Services will be suspended if payments are not made by the due date.
  • No Refunds: No prorated refunds for breaches involving confidentiality, NDA violations, or unethical behavior.

16. Feedback and Approval Acknowledgement

Approved content is considered final and acknowledged as meeting the client’s requirements. We are not liable for post-approval errors.

17. Portfolio and Case Studies

We may showcase completed work in our portfolio or case studies unless the client requests otherwise in writing.

18. Dispute Resolution

Disputes will first go through a 30-day mediation process. If unresolved, disputes will be referred to arbitration under the Malaysian Arbitration Act 2005.

19. Compliance with Laws

Both parties agree to adhere to all relevant laws, including the Malaysian Contracts Act 1950 and Communications and Multimedia Act 1998.

20. Data Retention

Client data may be retained post-agreement for portfolio purposes unless deletion is requested in writing.

21. Amendments

This policy may be amended in writing with mutual agreement between Mueble Solutions and the client.
